NSW Home Building Compensation insurance: what it covers—and what it doesn't

Quick answer: NSW Home Building Compensation (HBC) cover, previously called home warranty insurance, is primarily last-resort protection for eligible residential building work. It does not automatically fund repairs whenever defective work is discovered. Under the standard minimum framework, specified events involving the builder—such as insolvency, death, disappearance or a qualifying licence suspension—normally need to occur. SIRA.

Is home warranty insurance mandatory for a new house?

For eligible NSW residential building work exceeding $20,000 including GST, HBC cover is generally required unless an exemption applies. The obligation and timing rules depend on the project and arrangements, including speculative new homes and off-the-plan transactions. Always verify the property-specific cover rather than assuming that a brand-new house must have an effective certificate. NSW Government insurance requirements.

What triggers a claim?

SIRA identifies the main insured events as the builder's:

  • insolvency;
  • death;
  • disappearance; or
  • licence suspension following non-compliance with a qualifying court or NCAT money order in favor of the homeowner.

Other features may be offered in approved products. Policy wording and scheme requirements matter. The purchaser should seek written confirmation from the provider or professional adviser on complex fact patterns. SIRA claim guide.

Will HBC pay if my builder refuses to fix a defect?

Usually not for refusal alone. If the builder remains trading and the required event has not occurred, the ordinary path is to notify the insurer and attempt to resolve the defect with the builder, including appropriate Building Commission and NCAT steps. This is the central “insurance gap” consumers misunderstand.

How much is covered?

SIRA describes the minimum combined cover as $340,000 for eligible non-completion and defects. SIRA also describes approved options for separate construction-period and warranty-period products with minimum amounts of $340,000 for each relevant cover type. The actual policy may contain different approved features and claim limits. SIRA product explanation.

A $4 million house does not imply $4 million in HBC protection. A hypothetical $500,000 remediation estimate could exceed the minimum combined policy limit even before other conditions are considered. Do not calculate an insurance payout by simply subtracting $340,000 from an estimate: eligibility, covered loss, timing, excesses or other terms can change the outcome.

Does the insurance cover subsequent purchasers?

SIRA states the scheme can protect future homeowners as well as the original homeowner, within the relevant scope and timeframes. This makes confirming the exact HBC certificate, builder name, policy provider, type of work and dates especially important when buying a developer-built property. SIRA.

What is the difference between statutory warranties and HBC insurance?

Statutory warranties impose obligations relating to the work. HBC insurance is a separate mechanism that may cover eligible loss when an insured event occurs. A purchaser can have an enforceable statutory warranty claim without an immediately payable insurance claim. Read builder accountability.

What should I verify before exchange?

Request the HBC certificate and check that the names, address, dates, work description and provider align with the underlying build. Confirm whether the work is exempt, covered by combined or separate products, or affected by an off-the-plan arrangement. Compare project records and licensed-builder details; ask the insurer or SIRA about anomalies. Retain a copy in your due diligence file.

If a defect is discovered after purchase, notify the HBC insurer in writing promptly even if the builder is still trading. SIRA says notice within the relevant period is important to preserve rights. SIRA claim guidance.

Frequently asked questions

Does HBC cover all defects in a new NSW home?

No. It is subject to the insured event, eligibility, loss definition, policy terms, limits and timing requirements. It is not general comprehensive property-defect insurance.

Is the standard HBC limit $340,000?

SIRA identifies $340,000 as the minimum cover for the combined product and describes approved separate-cover alternatives. Verify the actual policy rather than assuming every arrangement is identical.

What if the developer becomes insolvent but the insured builder is solvent?

The insolvency of the selling developer does not automatically establish an insured event relating to the builder. The insured contractor and covered work must be identified.

How long do HBC protections last?

SIRA describes major-defect protection generally by reference to six years and other loss by two years from completion, with additional circumstances and notice requirements. Obtain advice on the precise start, end and notification dates.

Does an occupation certificate prove HBC insurance is valid?

No. A certificate of occupation and an HBC insurance certificate serve different purposes and must be checked separately.

If the policy is missing, should I buy anyway?

Treat missing or unclear cover as an unresolved material issue. Ask your lawyer and insurer to determine whether cover was legally required and whether practical protection exists before committing.
